A shooting and a police chase

William Tovar was shot in Los Angeles. Police later stopped the Cadillac Luis was driving with Hector Cuellar inside. Luis says he knew nothing about the shooting when he gave Hector a ride.

2006

Convicted after a second trial

A jury convicted Luis of attempted murder and found gang and firearm enhancements true. The sentence was nine years, plus ten years, plus 25 years to life.

2007

Judgment affirmed

The Court of Appeal found that giving an aiding-and-abetting instruction was error, but ruled the error nonprejudicial and affirmed the judgment.

2023

Crash begins

Across 20 episodes, Luis traces his childhood, the arrest, two trials, lawyers, prison life, and the affidavits his campaign says support reopening the case.

The identification changed.

Officers testified that Tovar identified Luis at the ambulance. The appellate opinion also records that Tovar later failed to identify Luis at a live lineup or in court and denied making the attributed identification.

02 / FIREARMS

No gun was recovered.

The appellate record says fragments indicated two weapons. Ammunition found in the Cadillac matched a caliber and manufacturer, but the opinion states that no firearm was recovered.

03 / INSTRUCTIONS

The appeal found an error.

The Court of Appeal agreed that the aiding-and-abetting instruction lacked evidentiary support, then held that the error did not prejudice the verdict.

04 / LATER ACCOUNTS

Three affidavits are central to Crash.
